The standards in this link are the same as IOSH construction and general
industry standards with the following exceptions:
Discrimination of Employees - brief synopsis -
Employers are to pay employees for time spent during walk-around and other Occupational
Safety and Health Inspection-related activities. This complete rule can be found in the
Iowa Administrative Code, Division of Labor Services [875], Chapter 9 (Chapter on
Discrimination), section 9.21(88). Also see statute 88.9.
Fire Fighters Protective Clothing and Equipment
- brief
synopsis - The rule provides for the adoption of standards for protective clothing and
equipment for fire fighters. This does not apply to volunteer fire departments for which
the rules are only advisory. For the complete statute see the Iowa Code, Chapter 88,
section 88.5(11). Also refer to Iowa Administrative Code Division of Labor Services [875]
Chapter 27.
Employees are - brief synopsis - Volunteers
responding to a Hazardous Waste Operation or Emergency response under 29 CFR 1920.120 are
covered by Chapter 88 and are not exempted from any part of the 1910.120 standard.
Inmates are considered to be employees when they work for maintenance, an
industry maintained by the institute, or perform any services for pay. For the complete
statute see the Iowa Code, Chapter 88, section 88.3(4).
Employee Citations - brief synopsis - A citation may be
issued to an employee who has failed to comply with the standards under his own volition.
To issue a citation to the employee, the inspector must know that the employee violated a
standard, the employee knew of the standard, and the employee knew he was violating the
standard. For the complete statute see the Iowa Code, Chapter 88, section 88.7(1)(b).
Iowa Employment Appeal Board - brief synopsis - It
provides that employees who serve on the appeal board are to be composed of 3 members. One
should represent the employers, one should represent the employees, and one should
represent the public. For the complete statute see the Iowa Code, Chapter 10, section
10A.601.
